MagicPlanner Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MagicPlanner, a digital homeschool planning application operated by Luminari Education, LLC (“Luminari,” “we,” “us,” or “our”). By creating an account or using MagicPlanner (the “Service”), you agree to these Terms. If you do not agree, please do not use the Service.

1. What MagicPlanner Is

MagicPlanner is a planning and organization tool that helps families map out a school year, schedule and reschedule lessons, assign work to children, attach resources, and let children view and complete their daily tasks.

MagicPlanner is a planning tool only. It is not a school, a school of record, or an accredited institution, and it does not issue transcripts, grades, diplomas, or official academic records. Nothing in the Service constitutes educational, legal, financial, or professional advice. You remain fully responsible for your family’s curriculum choices, instruction, and compliance with the homeschooling requirements of your state or jurisdiction.

2. Eligibility and Accounts

You must be at least 18 years old and the parent or legal guardian of any child you add to the Service to create an account. You are responsible for:

• Providing accurate account information and keeping it up to date.
• Maintaining the confidentiality of your login credentials and any Learner logins you create.
• All activity that occurs under your account and your family’s Learner profiles.

You are responsible for the children (“Learners”) you add and for supervising their use of the Service. Learner logins are created and controlled by you.

3. Subscriptions, Billing, and Refunds

Free and premium tiers. MagicPlanner offers a free tier and one or more paid (“premium”) subscription tiers. Certain features are available only to premium subscribers.

Billing. Premium subscriptions are billed on a recurring basis (for example, monthly) through our third-party payment processor. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

Automatic renewal. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.

Cancellation. You may cancel at any time through your account. Cancellation takes effect at the end of your current billing period and stops all future charges. Your premium features remain available until the end of the period you have already paid for.

Refunds. Payments already billed, including the current billing period at the time of cancellation, are non-refundable except where a refund is required by applicable law.

Billing terms. Paid plans are billed to your card through Stripe, monthly or annually. You may cancel future billing at any time and cancellation takes effect at the end of your current billing period. Price changes. We may change subscription prices or the features included in a tier. We will give you advance notice of any price increase, and changes will apply to your next billing period.

4. Your Content

You retain ownership of the content you add to MagicPlanner, including lessons, notes, schedules, links, and uploaded files (“Your Content”). You grant us a limited license to store, host, and display Your Content solely to operate and provide the Service to you and your family.

You are responsible for Your Content and for ensuring you have the right to use and upload it. You must not upload content that is unlawful, infringing, harmful, or that you do not have permission to use.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, copy, or resell the Service except as permitted by law.
• Upload malicious code or use the Service to harm others.

We may suspend or terminate accounts that violate these Terms.

6. Intellectual Property

The MagicPlanner Service, including its software, design, branding, and content we provide, is owned by Luminari and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your family’s personal, non-commercial homeschooling use. These Terms do not grant you any right to our name, logos, or branding.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your specific requirements. You are responsible for maintaining your own records and backups of important information.

8. Limitation of Liability

To the fullest extent permitted by law, Luminari and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

9. Indemnification

You agree to indemnify and hold harmless Luminari and its owners, employees, and contractors from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your violation of these Terms.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends, and we will handle your data as described in our Privacy Policy.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from your use of the Service will first be submitted to informal resolution by contacting us at hello@luminari.school before any formal action is taken.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date above and, where appropriate, notify account holders by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
